Notice Period For Resignation In an Employment to get Post Unemployment benifits

 If you want to quit from your current job and want a good reputation from your employer , the notice period you give is sufficient for them to arrange alternative for your position.You should be professional while leaving from your current employer so that they can expect a reasonable period of notice to be served.

If notice period was specified in job offer letter then employer seek that period should be satisfied. If you want to refer your current job in future then it will be good for you to follow the notice period specified by them.

As an employer should learn about what you can do to promote an effective claims process, including responding to requests for information from the Department of Unemployment Assistance (DUA) if any exists in the respective country.

The notice Period may vary from state to state and Country to country. Presently in India shops and establishment acts of  respective states may set the general notice period may be acceptable for both Employee and Employer

If your employment contract doesn't set out a notice period you should give a reasonable period of notice to your employer. This is an 'implied contract' as there is no written or verbal agreement, but is automatically provided by law. What is 'reasonable' will depend on your seniority and how long you have worked there.

Currently, there are numerous laws related to the welfare of labour and the most prominent ones are the Industrial Dispute Act, 1947, and the Shops and Establishments Act, 1954. But these laws have inconsistencies and are inadequate to deal with the complexities related to labour.

There is no standard format for employment contract under labour laws. So if labour laws are silent about any issues( for example say Unemployment benifit ) then contract will prevail.
